On Friday, an administrative law judge ruled that allowing Cincinnati-based healthcare provider The Christ Hospital to establish an outpatient surgery center in Northern Kentucky will benefit consumers who currently cross into Ohio for medical procedures. The McBrayer team represented The Christ Hospital throughout the certificate of need process that included nearly one year of filings and motions, as well as two extended four-day hearings held in August 2016 and January 2017. The administrative law judge's decision found a need for outpatient surgical procedures and approved plans for the construction of a 24,000-square foot ambulatory research center in Fort Mitchell, Kentucky.
St. Elizabeth Healthcare, the dominant provider of healthcare services in Northern Kentucky, plans to appeal.
